Terms of service
1. Scope and provider
These General Terms and Conditions (GTC) apply to all orders placed through the online shop obsi.store. The provider and contracting party is Mister-T GmbH, Hauptstrasse 64, 8264 Eschenz, Switzerland ("OBSI", "we"). For business customers (B2B), the terms of the respective individual quotation apply in addition.
2. Products
Our shirts are printed and finished in Switzerland once your order comes in (print on demand). Slight colour differences between the screen display and the product are technically possible. The size charts on the respective product page are decisive for the fit.
3. Conclusion of contract
The presentation of the products in the shop is a non-binding invitation to order. By submitting your order you make a binding offer to purchase. The contract is concluded when we confirm your order by email. We may correct obvious errors (e.g. price or system errors) before acceptance; in that case we will inform you.
4. Prices and payment
All prices are stated in Swiss francs (CHF) and include Swiss VAT as required by law, but exclude shipping costs. For deliveries to the EU and the United Kingdom, import charges may apply in addition; these are borne by the recipient (see shipping policy).
The payment methods shown at checkout apply (e.g. credit/debit card, Apple Pay, Google Pay, Shop Pay). The invoice amount is due when the order is placed.
Crossed-out prices correspond to our regular selling price outside the respective promotional period. Volume discounts, where active, are deducted automatically in the cart and cannot be combined with other order discounts.
5. Delivery
We deliver within Switzerland, to Liechtenstein and to selected countries in the EU and to the United Kingdom. You will find shipping costs, delivery times and details on customs and import charges in our shipping policy. Deliveries to the EU/UK are sent duty and tax unpaid (DDU); any import charges are borne by the recipient.
6. Exchange and right of withdrawal
For deliveries to Switzerland and Liechtenstein we offer a voluntary 14-day right of exchange (another size or another model, no refund of money). For deliveries to the EU and the United Kingdom, the statutory 14-day right of withdrawal with refund applies. Personalised or individually designed items are excluded in both cases. 7. Personalisation service
With the personalisation service you design an individual shirt together with us: you upload an image and describe your idea, and we send you a design proposal by email within 48 hours. Production only starts after your explicit print approval. Up until the print approval you can cancel the order free of charge; after the print approval, cancellation is excluded, as this is a custom-made item.
You warrant that you hold all necessary rights to the uploaded image and that no third-party rights (in particular copyright, trademark and personality rights) are infringed. We do not print content that is unlawful, offensive or discriminatory; we may reject such orders and will refund the purchase price in that case. We use your image exclusively to process your order and do not publish customer motifs without your consent.
8. Retention of title
The goods remain our property until they have been paid for in full.
9. Warranty
The statutory warranty rights apply (Switzerland: two years from delivery). If there is a defect, we will first provide, at our discretion, a replacement or a repair; if this fails, you can demand a price reduction or the rescission of the purchase. For consumers in the EU/UK, the mandatory warranty rights of their country of residence apply.
Please follow the care instructions (in particular: do not tumble dry). Damage caused by improper handling or normal wear and tear does not constitute a defect.
10. Liability
We are liable without limitation for intent and gross negligence as well as for personal injury. Otherwise our liability – in particular for slight negligence, indirect damage and consequential damage – is excluded to the extent permitted by law. Mandatory statutory liability provisions, including mandatory consumer rights, remain unaffected.
11. Intellectual property
All designs, texts, images and content of the shop are protected by copyright. Any reproduction, modification or commercial use without our written consent is prohibited.
12. Data protection
You will find information on the processing of your personal data in our privacy policy.
13. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If your habitual residence is in the EU or the United Kingdom, the mandatory consumer protection provisions of your country of residence remain reserved. The place of jurisdiction is – to the extent permitted by law – the registered office of Mister-T GmbH.
14. Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If you have any problems, contact us directly at any time at kontakt@obsi.store – we will find a solution.
15. Final provisions
Should individual provisions of these GTC be invalid, the rest of the contract remains valid. For new orders, the version of these GTC published at the time of the order applies.
